The ODA is also responsible for dealing with breaches of planning control and enforcement cases within the ODA planning area.

Investigation

The ODA Planning Decisions Team (PDT) will investigate alleged breaches of planning control. These breaches could result from people either starting construction work before they have gained the necessary approval or where they are not implementing a planning permission in accordance with the decision.

Potential action

If there has been a breach of planning control and the PDT consider that it is necessary to take action to remedy the breach, the PDT will contact the person carrying out the breach in order to rectify the situation.

The PDT has a number of actions open to it, including:

  • asking for a planning application to regularise the situation;
  • asking for the situation to be rectified voluntarily; and
  • serving a formal notice requiring action to be undertaken to rectify the breach.

Enforcement register

The PDT is responsible for keeping a register of information with respect of every formal notice that the ODA serves (Enforcement Notice, Breach of Condition Notice or Stop Notice). The register will be updated every time a formal notice is issued.
